A decision over Juventus’ appeal for Calciopoli damages will not arrive for at least 45 days.

 

The 2006 scandal saw the Bianconeri stripped of two Scudetti and demoted to Serie B, with the latter title awarded to Inter.

 

However, a judge later ruled that Nerazzurri director Giacinto Facchetti had also been in regular contact with referee designators.

 

As a result, the Turin club are pursuing a civil trial for €443m in damages from the FIGC, which will be adjudicated by the tribunale amministrativo regionale [TAR] in the Lazio region.

 

ANSA reports that the application was discussed today, and a decision has been held over for a period of at least 45 days.

 

FIGC President Carlo Tavecchio has warned a decision in favour of Juve would see the Federation “go bankrupt”, but hinted that if the suit is dropped there could be a compromise over the Scudetti.

Inter’s lawyer Luisa Torchia calls Juventus’ Calciopoli lawsuit “inadmissible and unfounded”.

 

The TAR in Lazio will make a judgement on the civil suit in 45 days at the earliest, as the hearing began today.

 

“This is pure sporting antagonism taken into the courtroom,” Tochia told reporters.

 

“Inter have nothing to do, Juventus’ position is inadmissible and unfounded. We expect the TAR to do its job.”

 

The Calciopoli scandal saw the Bianconeri stripped of two Scudetti and demoted to Serie B in 2006, with Inter awarded the 2005-06 title.

 

However, after subsequent trials established that the Nerazzurri had also made calls to referee designators, the Turin club are claiming for €443m in damages from the FIGC, citing unfair treatment.

 

The President of the Federation, Carlo Tavecchio, has warned that the FIGC will be bankrupted if Juve win the case.

Juventus' appeal for €444m of damages from the FIGC and CONI has been thrown out by the TAR court.

 

The Bianconeri were seeking damages for what they perceive as unfair punishment for their role in the 2006 Calciopoli scandal.

 

Two Scudetti were stripped from the Old Lady, with one awarded to Inter and the Turin club sent to Serie B as punishment.

 

Wiretaps later revealed that ex-Nerazzurri President Giacinto Facchetti had also been in regular contact with referee designators, but the statute of limitations had expired so no trial was ever brought.

 

Juve, citing loss of income and damage to reputation among other things, were seeking €444m in compensation, as well as the reinstatment of the two Scudetti.

 

However, the Tribunale Amministrativo Regionale has today thrown out their suit, believing that the matter had already been dealt with in a previous appeal submitted in 2006 but later withdrawn, with the club preferring to go to the CONI arbitration chamber, where they lost the case in October of the same year.

 

The judges therefore ruled that TAR could had no jurisdiction over something which had already been adjudicated.

Juventus have had their appeal against the Italian Olympic Committee (CONI) for its refusal to pay damages relating to the 2006 match-fixing scandal rejected by the regional administrative court (TAR) of the state of Lazio.

Juve were relegated to Serie B and docked points after being found guilty of running an "illicit system influencing games in the 2004-05 season," according to the official findings of a trial into the Calciopoli scandal.

The Turin-based club were not happy with the findings of that investigation and launched a legal bid for compensation from the Italian Football Association (FIGC). They demanded a payment of almost €440 million to cover the damages -- both financial and moral -- they incurred from being relegated, but FIGC rejected their claim.

The sports tribunal declared in 2011 that it could not rule on the issue, which is why Juve instead took their claim to the regional administrative court of Lazio, who dismissed it on Tuesday as "unfounded and inadmissible."

"The entire issue has already been dealt with in a previous claim, presented also by Juventus, in 2006 and then abandoned by the club, who preferred instead to take it to arbitration, where they did not succeed," read the statement from TAR, published by ANSA. "The TAR cannot deliberate on something that arbitration has already deliberated on."

Juve were not only stripped of their 2005 Scudetto, but the 2006 title which they also won was instead awarded to Inter Milan.

The Bianconeri returned to the top flight after just one season in Serie B, under the guidance of current France coach Didier Deschamps, although they did not win Serie A again until 2012, under Antonio Conte. Since then, they have gone on to win the last five league titles.

Vice President of Juventus Pavel Nedved has recounted his memories of playing for the club in Serie B.

 

The Bianconeri competed in Italy’s second tier during the 2007-08 season as a result of sanctions arising from the Calciopoli scandal.

 

Last night saw the opening of docu-film Juventus Story, which recounts the clubs 120 year history, and Nedved spoke backstage about his season in Serie B.

 

“Looking back I am very happy to have faced this experience, because we have earned respect, not only as footballers but as men.

 

This was great because we appreciated everything about it, not only our fans, but also the others.

 

“People pointed out that some of us were World Champions who were playing in the stadiums of Serie B. We were playing for Juve and it did not matter much, when you wear that shirt you go to fight."

Carlo Porceddu, one of the judges who presided over the Calciopoli trial in 2006, said revoking a Juventus Scudetto and handing it to Inter was “a very serious error.”

 

The trial had to be rushed during the summer of 2006 so that the fixture lists could be drawn up for the following Serie A season.

 

Juve were eventually demoted to Serie B with a points penalty and had two titles revoked – the 2004-05 edition was simply left unassigned, but the 2005-06 Scudetto was handed to Inter.

 

The Nerazzurri finished third in that campaign, but second-placed Milan were also docked points in the trial.

 

Inter supporters refer to that contested title as the ‘Moral Scudetto’ whereas Juventini call it the ‘Cardboard Scudetto.’

 

Now Porceddu, who was one of the judges on the tribunal in the Calciopoli trial and is now Vice-President of the Federal Court of Appeal, has broken his silence.

 

“Revoking the 2005-06 Scudetto from Juventus and assigning it to Inter was a very serious error,” Porceddu told L’Unione Sarda newspaper.

 

“The inquiry where we certainly should’ve done more was looking into Moggiopoli (Juventus director Luciano Moggi), but we in the Federal Court had limited the sanctions for Juventus, not revoking the 2005-06 title because there was insufficient evidence.

 

“Then the Extraordinary Commissioner of the Federation at that time (Guido Rossi) nominated a group of his friends, one of whom had been on the Inter Board of Directors, and that title was revoked from Juventus and assigned to Inter.

 

“In my view, that was a very serious error.”

 

Rossi was appointed as the temporary FIGC commissioner by the CONI (Italian Olympic Committee) after the Calciopoli scandal broke, as Federation President Franco Carraro resigned along with Vice-President Innocenzo Mazzini and President of the referees’ association Tullio Lanese.

 

Also penalised in the Calciopoli scandal were Fiorentina, Lazio, Reggina and Arezzo.

Paolo Liguori, the director of TGCom24, claims Juventus “have a consolidated system of satellite clubs like Atalanta and absolute power, just as much influence as during Calciopoli.”

 

The debate has come back to the fore after yesterday’s Coppa Italia semi-final, when Napoli complained about the refereeing and coverage of state broadcaster Rai.

 

Now other members of the media are emerging with surprising statements that could have larger repercussions.

 

Liguori is the director of Tgcom24, the news arm of Mediaset – the second largest independent broadcaster in Italy after Sky Sport Italia. He is also a Roma supporter.

 

“The Rai commentators were shameful, they were highlighting the great results earned by Juventus at home, but when you look at a thief’s bank account, you don’t take into consideration the money he stole,” Liguori told Radio Kiss Kiss.

 

“Instead, they do with Juventus. There is a consolidated system that includes satellite clubs. Just look at Atalanta, who played the performance of a lifetime against Napoli, and the same against Roma. Instead they sell Juve their best young players.

 

“At the Juventus Stadium it’s routine to see certain things now. The referees have also adapted to this context, so they seek young referees to conduct their little game. If they continue like this, you know that nobody can ever win in Turin.

 

“Even a cretin can understand that Pepe Reina touched the ball when challenging Juan Cuadrado. The penalty foul on Raul Albiol is clearer than the one given to Paulo Dybala. sefz

 

“Juventus have absolute power. It’s not like it was at the time of Calciopoli, but has just as much influence.”

Luciano Moggi’s lifetime ban from football has been definitively confirmed, after he was denied a final appeal.

 

The former Juventus general manager was banned for life from “any rank or category” of professional football for his involvement in the Calciopoli scandal.

 

Having seen appeals rejected by the sporting justice courts, Moggi attempted to take his case to the ordinary justice system, applying to the Consiglio di Stato.

 

However, the court has ruled that the case doesn’t fall under its jurisdiction, and denied the 79-year-old the right to appeal.

 

The FIGC’s original ruling is therefore confirmed, and Moggi’s lifetime ban is definitive.

Former FIGC chief Franco Carraro suggests Calciopoli was a bluff and admits “I had doubts over Juventus-Inter in 1998.”

 

Carraro was in charge of the Italian football during the Calciopoli scandal, which resulted in his resignation and Juve demoted to Serie B after they were found guilty of manipulating the designation of referees.

 

However, the 77-year-old hinted the bigger scandal was Ronaldo famously not being awarded a penalty when Inter played Juve for the Scudetto towards the end of the 1997-98 season.

 

“Luciano Moggi liked being called Lucky Luciano,” he told Corriere della Sera.

 

“He liked that Juve’s victories were partly linked to his ability to find players and way of influencing referees.

 

“Did he really influence them? He never succeeded in illicitly winning a title with Juventus.

 

“The only game that I had any doubts over was Juve-Inter, with that penalty not given to Ronaldo in 1998.

 

"Juve would have won those Scudetti anyway, they had the best Coaches Marcello Lippi and Fabio Capello.

 

"In fact in 2006 a Juventus-based national team on the World Cup."

Alessandro Del Piero has described Calciopoli as “an atomic bomb”, the effects of which are still being felt in Italian football.

 

Juve were infamously demoted to Serie B for their role in the refereeing scandal 10 years ao, but Del Piero claimed it also led to football in Italy ‘collapsing’ and other countries moving ahead.

 

“It was like an atomic bomb: our football broke down,” the former Bianconeri attacker told Gazzetta dello Sport.

 

“I’m not just talking about Juve. After that, the great champions went abroad and the other countries have grown exponentially:

 

“The Premier League has exploded thanks to its skill in managing its various brands around the world, as well as the shrewd distribution of its TV rights.

 

“Real and Barcelona have also moved forward with their respective corporate policies, Germany has completed the route it begun, when it was awarded the 2006 World Cup, and even big foreign investors have arrived in France to transform clubs like PSG and Monaco.

 

“Italy, on the other hand, collapsed, but Juve started coming back up and Napoli are on an important journey.”

FIGC Presidential candidate Gabriele Gravina has back-pedalled on the Juventus Calciopoli ruling. “They have 34 Serie A titles and must accept it.”

 

Gravina is the sole candidate for the election to President of the Italian Football Federation, but caused controversy this week when suggesting he was “not concerned” how many Scudetti Juve claimed to have.

 

This is because two were stripped in the Calciopoli scandal of 2006, reducing it to 34, yet Juventus continue to declare they have 36 in merchandise, on social media and even on their own stadium walls.

 

“I made a distinction between what an individual person thinks and the FIGC, which formally stabilises the number of titles,” clarified Gravina in Libero newspaper today.

 

“If Juve maintain they have 36 Scudetti, that is their problem and they are wrong. They have 34 Serie A titles and must accept it.

 

“What else can we do to make Juve realise they have 34 and not 36? I could say I’ve won a Scudetto, but nobody would believe me.

 

“The fact remains, in a difficult moment like this for Italian football, I can’t be worrying about someone who thinks they’ve got 36 titles.”

Juventus directors acquitted

Antonio Giraudo, Luciano Moggi and Roberto Bettega, the former Juventus directors, have been acquitted of false accounting charges dating back to 2001.

 

The three were implicated in the 2006 Calciopoli scandal, leaving the club that summer in disgrace.

 

Prosecutors had, in separate charges, accused the three of cooking the books by overstating ticket sales and commissioning Juventus intermediary fees which didn’t exist.

 

Under particular scrutiny were the transfers of Zinedine Zidane, Enzo Maresca, Fabrizio Miccoli, and Adrian Mutu.

All three were acquitted of the charges in 2009, but prosecutors appealed that decision.



 

Today Turin’s appeals court confirmed the acquittal because the statute of limitations has expired.

Juventus’ appeal against the revocation of the 2006 Scudetto has been thrown out by the Supreme Court of Cassation, which decided it was a sporting issue.

 

The Bianconeri were stripped of both the 2004-05 and 2005-06 titles as part of the Calciopoli scandal, which also saw the club relegated to Serie B.

 

The second of those was controversially awarded to Inter, who in 2011 were accused by prosecutor Stefano Palazzi of similar offences to the ones which saw Juve demoted.

 

However, as the statute of limitations had expired no action could be taken.

 

Juventus asked for the 2006 Scudetto to be stripped from Inter as a result, but the FIGC declined to rule on it as too much time had passed.

 

The Bianconeri then appealed to the Consiglio di Stato, but it was decided that court had no jurisdiction over sporting bodies.

 

A further appeal to the Court of Cassation followed, but that appeal was thrown out today.

 

The court confirmed that the dispute falls under the remit of the sporting justice system, and for an outside court to rule on the issue would undermine “the principle of autonomy of the national sports system”.

 

The Supreme Court of Cassation doesn’t re-examine the facts of a case, it can only interpret the relevant law, and in this case it upheld the earlier verdict that the civil courts have no jurisdiction over sporting disputes.

 

Given that the court is the highest court of appeal, it would appear there are no more avenues for Juventus to go down.

Former Inter President Massimo Moratti said “Juventus fans have to accept” the final verdict that the 2005-06 Scudetto belongs to the Nerazzurri.

 

Both the 2004-05 and 2005-06 Serie A titles were stripped from Juve as part of the Calciopoli scandal in the summer of 2006.

 

While the 2004-05 edition went down as ‘unassigned’, the 2005-06 Scudetto was handed over to Inter, who finished third that season behind Milan (also penalised in the Calciopoli trial).

 

Juve have been waging a legal battle for years to have the 2005-06 title either given back to them or also marked down as neutral rather than have it included on the shelf of their rivals, but lost the final appeal today.

 

“It’s all normal, a consequence of what happened,” Moratti told news agency Ansa.

 

“In any case, that’s good, it has always been a guaranteed Scudetto. Now the Juventus fans have to accept it too. .fuck

 

“I was sure that would’ve been the case anyway. I’ve always been friends with (Juventus President Andrea) Agnelli, let’s just say that nowadays that affection is a little more public than it was…”

Juventus have officially lodged yet another appeal to have the 2005-06 Serie A title removed from Inter.

 

In the Calciopoli scandal of 2006, the Bianconeri had two Scudetti revoked – the 2004-05 edition went unassigned, while the 2005-06 title was handed to third-place Inter.

 

That is because Milan, who had finished second, were also docked points in the trial, along with Lazio, Fiorentina, Reggina and Arezzo.

 

Juventus have had several different appeals to have the titles returned, or at least the later trophy taken away from their rivals Inter.

 

After the most recent legal action was rejected, the club today formally lodged another appeal with the Collegio di Garanzia dello Sport tribunal.

 

Most of the appeals have dealt not with the issue itself, but on who gets to decide.

Former Juventus boss Fabio Capello has branded the decision to award Inter the 2005-06 Scudetto a ‘joke’.

 

Capello’s Juve appeared to have won that season’s Serie A title on the field, before it was taken away from them due to their involvement in the Calciopoli scandal and given to their arch-rivals.

 

“It was a joke and clearly unfair to have assigned that Scudetto to Inter,” he said in the second part of his interview with Radio Anch’io Sport.

 

“The timing wasn’t respected and the rules didn’t allow for sporting justice to operate properly.

 

“Guido Rossi [the FIGC’s extraordinary commissioner at the time] acted too hastily.”

 

Napoli were warned against walking off the field after Kalidou Koulibaly was racially abused against Inter, so the ex-Milan and Roma Coach has a solution…

 

“Players should sit on the field and they shouldn’t be punished,” he continued. 

 

“By doing that, it would help the fans who are behaving and want to watch football, while forcing those guilty of monkey chants to stop and feel ashamed of what they’re doing.

 

“Italy’s the only country where the ultras are in charge and the players go to greet them. We give too much importance to these people.

 

“Around 85-90% of the fans who come to the stadium are important, not these gentlemen with banners, slogans and power given to them by their clubs.”

 

However, Capello was more positive on the topic of Roberto Mancini’s Italy reign.

 

“Mancini’s done a good job of putting new Italian talent to the test. They have the ability to play for the national team, where they can take responsibility,” he concluded.

 

“You must be bold to make play them and now it seems that bravery has arrived.”

Juventus have lost their appeal to have the 2005-06 Serie A title revoked from Inter after the Calciopoli scandal.

 

The Bianconeri had two titles revoked in the scandal in the summer of 2006, but as the first was in 2004-05 and left unassigned, the 2005-06 edition was instead given to Inter.

 

The Nerazzurri finished third that year behind Juve and Milan, but were the highest-rated club after points were docked for the scandal of trying to influence or pressure the choice of referees.

 

Juve had lodged an appeal to have the case reopened, taking on the FIGC and Inter, but the CONI (Italian Olympic Committee) ruled this evening that the appeal was inadmissible.

 

This confirms the original attempt to appeal, which was ruled inadmissible in 2011 by the TNAS, despite the emergence of new evidence.

 

New wiretaps were discovered many years later that had Inter involved in not dissimilar behaviour to Juventus, but the statute of limitations had already passed and action could not be taken.

 

The Turin club had asked for the title returned to them, or at least for it not to be assigned to Inter.

 

Juventus continue to count the 2004-05 and 2005-06 Serie A titles as theirs on merchandise and even the walls of the Juventus Stadium.

Juve had the title revoked due to their role in the 2006 Calciopoli scandal, before it was given to Inter.

 

The Bianconeri have tried and failed in years gone by to at least deprive the Nerazzurri of that season’s crown.

 

However, it was confirmed on Monday that the Old Lady had presented a new appeal to the CONI’s Collegio di Garanzia dello Sport tribunal.

 

The development comes less than a week before the two clubs face off in the Derby d’Italia.

There were five Serie A fixtures this weekend that were meant to be played behind closed doors, as they are in the regions most affected by the infectious respiratory disease.

 

Those games were Juventus-Inter, Udinese-Fiorentina, Milan-Genoa, Sassuolo-Brescia and Parma-SPAL, rescheduled to May 13.

 

This decision prompted a great deal of criticism, particularly from fans of Inter, because their fixture list is going to be packed to the rafters for the final few weeks of the season.

 

They already have a game with Sampdoria to be rescheduled, called off last week, and it’s currently not clear when that can be played.

 

Inter ultras from the Curva Nord held out a large banner in front of the Lega Serie A headquarters this evening: ‘Calciopoli, is it happening again?’ ......

Nearly 14 years after Italy’s biggest soccer scandal, appeals are still ongoing.

Former Juventus director Antonio Giraudo, who was banned from the sport for life following a 2006 match-fixing scandal, submitted an appeal to the European Court of Human Rights on Monday.

 

According to Italian news agency LaPresse, Giraudo claims that by allowing sports federations to set up disciplinary courts, Italy violated an article of the Convention on Human Rights that grants access to a court established by law and a fair trial.

The appeal also states Giraudo’s lawyers were only given seven days to prepare his defence and that jurisdiction was handed to the same body — the Italian soccer federation — that had made the accusations.

Italian financial journalist Marco Bellinazzo explains why Juventus do not risk being relegated although this scandal is ‘worst than Calciopoli.’

The Bianconeri have been docked 15 points due to financial irregularities .....

 

Juventus fans fear the team will face an even higher penalty during the season, which could see them relegated to Serie B as it happened in 2006 after the famous match-fixing scandal infamously known as Calciopoli.

Bellinazzo admits that the ‘salaries trial’ could have “bigger consequences” for the Serie A giants. ......

 

So, could Juventus be relegated again?

“It’s one of the options, but to get there, false accounting must be proved along with the fact that Juventus didn’t have the financial requirements they claimed. This is very difficult to prove because during the last three years, they also had a cash injection of €700, so I would rule out this sort of sanctions. Nevertheless, we don’t know the content of all the 14.000 pages collected by the Turin Prosecutor which will be revealed during the preliminary hearing on March 27.”

Minister for Sport Andrea Abodi is eager to hear the motivation for the 15-point penalty against Juventus and hints he will ‘probably propose action to improve the transparency and efficiency of the sporting justice system.’

 

The Bianconeri were docked 15 points for artificially inflating transfer fees in exchange deals to boost capital gains, therefore allowing them to balance the books. .........

 

“It is just as important to explain as it is to decide,” warned Minister of Sport Abodi.

“I therefore wait for the written motivation and those who are responsible for this decision need to explain why it was taken and not others.” ......

 

“After that, there is a political responsibility to change the rules, respecting the autonomy of sport, because degenerative tendencies need to be limited. And the interpretation of these events is limited,” continued Abodi.

“We want sport to be transparent, efficient, dignified, credible and with a strong reputation. Clearly, what is happening right now does not contribute to those objectives. ........

 

“I do hope that all this will not become just a basic issue of the club you support against the others, but I understand that some fans will see it that way.” ......
